Differential Wage Payment definition

Differential Wage Payment means any payment, including specifically a payment under s. 230.315, that satisfies all of the following:
Differential Wage Payment means a payment made on or after January 1, 2009:
Differential Wage Payment means any payment which: (a) is made by an Employer to a Participant with respect to any period during which the Participant is performing service in the uniformed services while on active duty for a period of more than 30 days; and (b) represents all or a portion of the wages that the Participant would have received from the Employer if the Participant were performing services for the Employer.

Examples of Differential Wage Payment in a sentence

  • For years beginning after December 31, 2008, an individual receiving a Differential Wage Payment from the Employer is treated as an Employee of the Employer.

  • For purposes of applying any Code-based requirements to this Plan, including, but not limited to, the limitations under Code Section 415 and any applicable nondiscrimination requirement, a Participant receiving a Differential Wage Payment will be treated as an employee of the Employer making the payment, and the Differential Wage Payment will be treated as “compensation” of the Participant receiving the payment.

  • Effective for Differential Wage Payments made after December 31, 2008, the Plan is not treated as failing to meet the requirements of any provision described in this Section 3.11(F) by reason of any contribution or benefit which is based on a Differential Wage Payment.

  • An individual receiving a Differential Wage Payment shall be treated as an Employee of the Employer making the payment.

  • For all purposes hereunder, Compensation shall include a Differential Wage Payment, as defined below.A Differential Wage Payment means a payment by an Employer to an individual who is performing service in the uniformed services (as defined in Chapter 43 of Title 38 of the United States Code) while on active duty for more than 30 days, which represents all or a portion of the wages the individual would have received if the individual were performing service for the Employer.


More Definitions of Differential Wage Payment

Differential Wage Payment means a payment under Section 3401(h) of the Code that is paid to a Participant during any period when the Participant is performing Qualified Military Service while on active duty for more than 30 days.
Differential Wage Payment means a payment under Section 3401(h) of the Code that is paid to a Participant because the Participant is performing Qualified Military Service while on active duty for more than 30 days.
Differential Wage Payment means any payment which: (a) is made by an employer to an individual with respect to any period during which the individual is performing service in the uniformed services while on active duty for a period of more than 30 days; and (b) represents all or a portion of the wages that the individual would have received from the employer if the individual were performing services for the employer.
Differential Wage Payment means any payment which is made by the Employer to an Employee with respect to any period during which the Employee is performing service in the uniformed services (as defined in chapter 43 of title 38 of the Code) while on active duty for a period of more than thirty (30) days, and such payment represents all or a portion of the wages the Employee would have received from the Employer if the Employee were performing service for the Employer.
Differential Wage Payment means any payment that (i) is made by an Employer to a Participant with respect to any period during which the Participant is performing service in the uniformed services (as defined in chapter 43 of title 38, United States Code) while on active duty for a period of more than 30 days, and (ii) represents all or a portion of the wages the Participant would have received from the Employer if the Participant were performing service for the Employer.
Differential Wage Payment means any payment that, under the policies that may be established from time to time by the Employer, is made by the Employer to an individual with respect to any period during which the individual is performing service in the Uniformed Services while on an active duty for a period of more than 30 days, and which represents all or a portion of the wages the individual would have received from the Employer if the individual were performing service for the Employer, all within the meaning of Section 3401(h)(2) of the Code. Further, the Plan will not be treated as failing to meet the requirements of any provision described in Section 414(u)(1)(C) of the Code by reason of any contribution or benefit that is based on such Differential Wage Payments, but only if all Employees of the Employer performing services in the Uniformed Services are entitled to receive Differential Wage Payments on reasonably equivalent terms and, if eligible to participant in a retirement plan maintained by the Employer, are eligible to make contributions based on such Differential Wage Payments on reasonably equivalent terms.
Differential Wage Payment means any payment made by the Employer to a Participant with respect to any period during which the Participant is on active duty in the uniformed services for a period of more than 30 days.
