Disponent Owner definition

Disponent Owner means any party contracting with the Owner to charter or otherwise commercially dispose of the Vessel, typically a bareboat/demise charterer, or any other party who controls the Vessel and enjoys the benefit thereof under a similar arrangement.
Disponent Owner means, with respect to any particular Vessel, the party identified as the disponent owner of such Vessel on Schedule 2 hereto.
Disponent Owner means the person who has the right to use and possession of the Vessel, either as owner or as bareboat charterer from the owner of the Vessel, for the time being, and the expression “disponent ownership” shall be construed accordingly.

  • The above is without prejudice to such other rights the Seller may have against the Buyer and/or the Receiving Vessel in the event of non-payment, including the right to attach the Receiving Vessel and/or its sister vessel and/or any other assets of the Buyer (or the Owner of the Vessel, including the Disponent Owner) wherever situated in the world without prior notice.

  • If, for any reasons whatsoever, the BDN is not personally signed and stamped by the Master of the Vessel, the person signing it undertakes, represent and guarantees that he has authority to sign on behalf of the Master and/or the Owner, Disponent Owner or Operator of the Vessel so as to bind the Vessel in rem.

  • At time of nomination, Owner/ Disponent Owner also to provide a completed Muntajat Questionnaire for Dry Cargo Vessels (as per Annex C attached).

  • Prior to the delivery, the Master, First Officer or Chief Engineer (as may be applicable, but always implied that they have full authority binding upon the Vessel’s Owner and Disponent Owner) of the Vessel to be supplied will confirm the quantity and description of the Marine Fuel, signing and stamping with the Vessel Owner’s seal (or seal of the Vessel) the document called “Confirmation of Supply and Invitation to Witness Measurements”, that will be delivered to him by the Seller.

  • If this clause applies, any references to “Owner” in these Conditions shall apply mutatis mutandis to the Disponent Owner.

  • This clause only applies if the Disponent Owner has agreed under its contract with the Owner to be liable for the supply of Products to the Vessel.

  • Prior to the delivery, the Master, First Officer or Chief Engineer (as may be applicable, but always implied that they have full authority binding upon the Vessel’s Owner and Disponent Owner) of the Vessel to be supplied will confirm the quantity and description of the Marine Fuel, signingand stamping with the Vessel Owner’s seal (or seal of the Vessel) the document called “Confirmationof Supply and Invitation to Witness Measurements”, that will be delivered to himby the Seller.

  • If, at the time of delivery of the Products, the Vessel is under the control of a Disponent Owner, the Disponent Owner shall be deemed liable for payment of the Products as party to the Contract in the Owner’s stead even if not named as a Buyer under the Contract and regardless of whether the agent acting for the Disponent Owner when ordering the Products from the Seller has disclosed the existence and/or identity of the Disponent Owner.

  • Co-Owner means a Person who owns an Ownership Interest and a Co-Owner of a Series means a Person who owns an Ownership Interest of the Series.

  • Generator Owner means the Person that owns the Generating Facility and has registered with the NERC as the Person responsible for complying with all NERC Reliability Standards applicable to the owner of the Generating Facility.

  • Owner means the person in whose name American Depositary Shares are registered on the books of the Depositary maintained for that purpose.

  • Contract Holder means the person to whom the Benefit Plan is issued. Any other person approved for coverage with the Contract Holder under this plan is a dependent. Under Group coverage, the Contract Holder is the Member who is eligible for coverage because of his or her affiliation with a Group.
