Draw Package definition

Draw Package has the meaning set forth in Section 2.04(a) hereof.

Draw Package a monthly submission made by the Borrower to the Administrative Agent and the Construction Consultant in connection with any Current Project in accordance with Section 5.3, which shall include:

Draw Package means the documents and other items required to be provided to the Administrative Agent and/or the Construction Consultant under Section 3.03.

• To request an Advance, Borrower shall deliver a Draw Package to Administrative Agent by electronic communication as provided in Section 11.01 hereof, not later than 11:00 a.m., New York City time, 10 Business Days before the date of the proposed Advance.

Draw Package. The documentary demand for payment, dated and signed by the Securities Administrator, on behalf of the Trustee, stating on its face “Drawn under U.S. Central Credit Union Irrevocable Standby Letter of Credit No. CM2004-002” accompanied by a copy of the Standby Letter of Credit and a fully executed and completed Draw Package Certificate.

Draw Package means all of the fully signed (and, as applicable, witnessed and notarized so as to be in recordable form), certificates, sworn statements, affidavits, waivers, releases, terminations, W-9 forms and other materials and documents relating to requested payments to the Contractor or any Subcontractor or material supplier, and such other items and dollar amounts requested under any Disbursement Request so that the Escrowee and Title Insurer will have all required documents and materials necessary to review and approve a Disbursement Request and issue a Disbursement Endorsement as contemplated under the Disbursement Agreement. Each Draw Package must, at a minimum, include: (a) the documents referenced in Exhibits Y-1 – Y - 6, (b) statements, affidavits, waivers, releases, terminations, and any other document or item which shall be accurate, fully completed and duly executed (and, as applicable, witnessed and notarized so as to be in recordable form), (c) all certifications, exhibits, attachments, schedules, appendices and certificates, and (d) a list and copies of any and all “Notices to Owner” received by the Borrower, the Contractor or their affiliates not previously delivered to the Escrowee.

Draw Package means the monthly request prepared by Developer and delivered to the County for disbursement from the Available Funds in accordance with Section 9.6.2.1 hereof.

Draw Package means the draw package constituting the documents and other items set forth on Schedule 6.9(b) hereto. Common Member shall submit each Draw Package in accordance with the provisions of Section 6.9.
