EME definition

EME means an Exempted Micro Enterprise in terms of a code of good practice on black economic empowerment issued in terms of section 9 (1) of the Broad-Based Black Economic Empowerment Act;
EME means any enterprise with an annual total revenue of R5 million or less .

  • An EME is only required to obtain a sworn affidavit on an annual basis, confirming 1) Annual Total Revenue of R10 million or less; and 2) the Level of Black ownership.

  • A bidder awarded a contract may not sub-contract more than 25% of the value of the contract to any other enterprise that does not have an equal or higher B- BBEE status level than the bidder concerned, unless the contract is sub- contracted to an EME that has the capability and ability to execute the sub- contract.

  • Respondents are responsible for all due diligence on their subcontractors.If contemplating subcontracting, a Respondent will not be awarded points for B-BBEE if it is indicated in its Proposal that such Respondent intends subcontracting more than 25% [twenty-five percent] of the value of the contract to an entity/entities that do not qualify for at least the same points that the Respondent qualifies for, unless the intended subcontractor is an EME with the capability to execute the contract.
