Emergency surgery definition

Emergency surgery when used in this Schedule D section 2.0 means emergency surgery that is defined, deemed or adjudicated under MSP to be emergency surgery.
Emergency surgery means an operation or surgery performed in a medical emergency [as defined in Subparagraph (b)(25) of this Rule] where informed consent cannot be obtained from an authorized person, as specified in G.S. 90-21.13, because the delay would seriously worsen the physical condition or endanger the life of the client.
Emergency surgery means surgery which is not Elective Activity performed when the Patient’s life or well-being would be in immediate or short term jeopardy without surgical intervention. Employer’s Liability is defined in Section 5(a)(i) of the Insurance Schedule.
