EMS Consultant definition

EMS Consultant means the party identified in Paragraph 37 as approved by EPA and meeting the qualifications set forth in Paragraph 38, and contracted by the Defendants to perform the duties set forth in Paragraph 39, including assisting Defendants in the development of an EMS and EMS manual;
EMS Consultant means the independent third-party environmental consultant previously approved by EPA to perform the Gap Analysis and prepare the EMS Manual, which was approved by EPA, after consultation with the State.
