The Consultant shall not transmit confidential, personal, or sensitive data via e-mail or other internet transport protocol unless the data is encrypted by a solution that has been validated by the National Institute of Standards and Technology (NIST) as conforming to the Advanced Encryption Standard (AES) Algorithm.
The decision to enter into any such Third-Party Encryption Terms will be at the discretion of the Partner.
All data transmissions of PII outside of a secure internal network must be encrypted using a Federal Information Processing Standard (FIPS) 140-2 certified algorithm that is 128 bit or higher, such as Advanced Encryption Standard (AES) or Transport Layer Security (TLS).

Any Partner use of the Sublicensed Encryption Software is subject to this Agreement, including the licence and other terms set forth in Paragraphs 2.2 to 2.5 (inclusive) of Annex 3 (Security Requirements).
