Excluded Patents definition
Excluded Patents means patents owned by Seller, but does not include the Retained Patents or the Acquired Patents. “Facility Lease” has the meaning set forth in Section 3.02(a)(iii).

Excluded Patents means (i) the U.S. patents listed on Exhibit G hereto; (ii) any U.S. patent issuing at any time from a patent application to which any patent listed on Exhibit G claims priority; (iii) any U.S. patent issuing at any time from a divisional, continuation, or continuation-in-part of a patent application to which any patent listed on Exhibit G claims priority; (iv) all reissues, reexaminations, and extensions of any of the foregoing (i), (ii), and (iii); and (v) all non-U.S. patents and non-U.S. patent applications, and all extensions thereof (for example, any Supplementary Protection Certificate).

Notwithstanding anything in this Agreement to the contrary, for purposes of this Article V, the terms “Acquired Assets” and “Seller Intellectual Property” shall be deemed to include the Excluded Patents.
More Definitions of Excluded Patents
Excluded Patents means all Patents that are owned by any member of the JDSU Group or the Lumentum Group, other than the Transferred Patents.
