Examples of Existing Subordinated Obligations in a sentence
Upon the Closing, the Old Debt Agreements shall be superseded by this Agreement, the New Subordinated Note Indenture and (to the extent applicable) the other Restructuring Documents and shall be of no further force and effect (provided that the Existing Subordinated Obligations shall have been renewed, extended and otherwise satisfied pursuant to subsections 3.2(a) and (b)).
Written notice shall have been delivered to each holder of the Existing Subordinated Obligations of the amount of the Loan hereunder.
Upon an Event of Default or Events of Default, such Event of Default or Events of Default may be waived, but only: (i) with respect to the Senior Lenders, by the holders of a majority of the Senior Obligations outstanding on the date thereof, or (ii) with respect to the Existing Subordinated Lenders, by the holders of a majority of the aggregate principal amount of the Existing Subordinated Obligations outstanding on the date thereof.
