Facility User definition

Facility User. , for a facility, means a person who has access to the facility under an access agreement.
Facility User means persons, firms or corporations authorized, invited or providing services, labor, material, supplies or equipment on Port marine terminal facilities or who are using or receiving the services of the Port and/or its marine terminal facilities. “Facility User” includes but is not limited to ocean carriers, inland water and land carriers (including rail and truck), and the owners, shippers and consignees of cargo or merchandise.
Facility User means any person or entity authorized, invited or providing services, labor, materials, supplies or equipment on or in connection with the Port marine terminal facilities or who otherwise uses or benefits from the use of the marine terminal facilities and/or services of the Port for any purpose, including, but not limited to, docking and unloading, loading, moving, handling, and storing materials, supplies, equipment, cargo, merchandise or any other property. “Facility User” includes but is not limited to vessels, carriers (including ocean, inland water, rail, and truck), vessel owners, vessel charterers and operators, steamship lines or agencies, stevedores, freight forwarders, brokers, shippers, consignees, consignors, and any person or entity that possesses an interest in any cargo or merchandise or other property located on or moving over the terminal facilities. “Facility User” shall also be deemed to include the Facility User’s respective officers, partners, owners, employees, contractors, subcontractors, vendors, agents, and invitees.

  • In the course of using the Facility, User shall make reasonable efforts to not give User’s Confidential Information to Others or any third party.

  • Notwithstanding said policy or policies of insurance, Facility User shall be obligated for the full and total amount of damage, injury, or loss caused by negligence or neglect connected with this Agreement or with use or occupancy of the Premises.

  • Facility User shall be responsible for obtaining any use permits, licenses or other permission for its Activities from the City or other governmental agencies having jurisdiction.

  • The Facility User must designate a responsible adult of more than 21 years of age to be present during the time the Facility is being used by the Facility User, and adequate adult supervision, as well as security personnel in appropriate circumstances (such as, by way of example only, a teen dance or party), must be provided when persons under the age of 21 use the Facility.

  • Facility User shall furnish District with the original certificates and amendatory endorsements effecting coverage required.


More Definitions of Facility User

Facility User means (i) the Owner Lessor, (ii) any Person to which the Owner Lessor has transferred its interest in the Facility or is leasing the Facility, or (iii) any other Person during the time and to the extent such Person has possession and control of the Facility, in each case under circumstances giving the Owner Lessor or such Person, as the case may be, the right to market and sell Energy from the Facility for its own account, including any Person designated by the Owner Lessor to be so entitled.
