Facility definition

Facility means the entire operation located on the property where the Equipment is located;
Facility means any real property (including all buildings, fixtures or other improvements located thereon) now, hereafter or heretofore owned, leased, operated or used by Borrower or any of its Subsidiaries or any of their respective predecessors or Affiliates.
Facility means the Term Facility or the Revolving Credit Facility, as the context may require.

Examples of Facility in a sentence

  • The Borrower may, subject to the provisions of this Agreement and without premium or penalty, prepay Advances outstanding under the Loan Facility (together with accrued and unpaid interest thereon) upon five (5) Business Days’ notice to the Lender, which shall be irrevocable and binding on the Borrower and which shall specify the proposed date and aggregate principal amount of the prepayment.

  • The Borrower acknowledges that the Lender has relied upon all representations and warranties in the making of the Advances and establishing the Loan Facility.

  • Notwithstanding the foregoing, the Company may rescind or postpone any notice of termination of the Commitments if such termination would have resulted from a refinancing in total of a Facility, which refinancing shall not be consummated or otherwise shall be delayed.

  • Any Incremental Term Loans effected through the establishment of one or more new Incremental Term Loans made on an Incremental Facility Closing Date shall be designated a separate Class of Incremental Term Loans for all purposes of this Agreement.
