arbitration agreement means an agreement by the parties to submit to arbitration all or certain disputes which have arisen or which may arise between them in respect of a defined legal relationship, whether contractual or not;
Release of Claims means the Release of Claims in substantially the same form attached hereto as Exhibit A (as the same may be revised from time to time by the Company upon the advice of counsel).
Conciliation agreement means a written agreement setting forth the resolution of the issues in conciliation.
Arbitration Notice has the meaning set forth in Section 9.13.
Pending Litigation means a proceeding in a court of law whose activity is in progress but not yet completed.
the decisions means the decisions of the CMA on the questions which it is required to answer by virtue of section 35 of the Act;

In the event, there is an error regarding fee simple or ground rent in the chain of title including deeds, the Buyer shall take title with the existing ground rent of record and there shall not be a monetary penalty to the seller. In event of a ground rent escrow, the title company or settlement company agrees not to charge an escrow holding fee to the seller. If the Trustee/ Seller is unable to convey good and marketable title, the purchaser's sole remedy in law or equity shall be limited to the refund of the deposit. Upon refund of the deposit this sale shall be null and void and of no effect, and the purchaser shall have no further claim against the Trustee/ Seller or Auctioneers.
Expedited Appeal means if a Member appeals a decision regarding a denied request for Prior Authorization (Pre-Service Claim) for an Urgent Care Claim, the Member or Member’s Authorized Representative can request an Expedited Appeal, either orally or in writing. Decisions regarding an Expedited Appeal are generally made within seventy-two (72) hours from the Plan’s receipt of the request.
Stipulation means this Stipulation and Agreement of Settlement.
General Release has the meaning stated in Section 6.03.
Legal notice means every notice required by law or by order of a court to be published in a newspaper or other publication, except notices required by private and local laws to be published in newspapers, and includes all of the following:
Mutual Release means the General Mutual Release substantially in the form attached hereto as Exhibit B in all material respects.
Final Order and Judgment means the final judgment and order of dismissal with prejudice to be entered in the Lawsuit in connection with the approval of the Settlement after the Final Approval Hearing.
Mediation agreement means a written agreement between the parties to a mediation meeting.
Release Agreement means an agreement, substantially in a form approved by the Company, pursuant to which Executive releases all current or future claims, known or unknown, arising on or before the date of the release against the Company, its subsidiaries and its officers.
Rules of Procedure means the rules of procedure adopted by the Fund Council for the management of its own business, as originally adopted on July 16, 2010 and amended from time to time.
rules of court means Rules of Court made under this Act and includes forms;
Arbitration Act means the Arbitration and Conciliation Act, 1996 and shall include any amendment to or any re-enactment thereof as in force from time to time.
Notice of Arbitration means the formal notice from the CONTRACTOR or the CUSTOMER to the other party referring a dispute to arbitration in accordance with the provisions of Schedule 2-9.
Terms of a trust means the manifestation of the settlor's intent regarding a trust's provisions as expressed in the trust instrument or as may be established by other evidence that would be admissible in a judicial proceeding.
Notice of Motion means a notice setting out the text of a motion, which it is proposed to move at the next relevant meeting;
Court of Appeal means the division of the Supreme Court referred to in section 7(1)(b);
Dispute Resolution Procedure means the procedure for resolving disputes as set out in Clause 17 (Dispute Resolution);
Commissioner of Competition means the Commissioner of Competition appointed pursuant to Subsection 7(1) of the Competition Act or his designee.
General Agreement means the Government Officers Salaries, Allowances and Conditions General Agreement PSA AG 25 of 2002 or its replacement or the Public Service General Agreement PSA AG 24 of 2002 or its replacement whichever is applicable.
JT No-Action Letters means SMC Capital, Inc., SEC No-Action Letter (pub. avail. Sept. 5, 1995) and Massachusetts Mutual Life Insurance Company, SEC No-Action Letter (pub. avail. June 7, 2000).
