Fourth Stage definition

Fourth Stage means the obligations of the Assignee set forth in Section 4 below, under that term;
Fourth Stage. If the grievance is not resolved satisfactorily to the Union within ten (10) days after the hearing before the Board (Third Stage), there shall be available a fourth stage of impartial arbitration. The Board shall submit its decision in writing to the Union. The Union shall submit a request in writing to enter into such arbitration within twenty (20) days of receipt of the Board’s decision. The American Arbitration Association shall be requested jointly by the parties to provide a panel of five (5) arbitrators within five (5) days thereafter. Each of the two parties will alternately strike one name at a time from the panel until only one shall remain. The remaining name shall be the arbitrator. He/she shall abide by the rules of the American Association of Arbitrators. The Union may elect to process any arbitration pursuant to the expedited arbitration rules of the American Arbitration Association. The Board and the Union will abide in good faith with the decision of the arbitrator to the extent permitted by law. Expenses which are common to both parties to the arbitration, including the cost of the arbitrator, shall be borne equally by the Board and the Union. Each party to the arbitration proceedings shall be responsible for compensating its own representatives and witnesses.

Examples of Fourth Stage in a sentence

  • Fourth Stage: If the grievance is not resolved satisfactorily to the grievant and the Association after the third stage, there shall be a fourth stage of impartial arbitration.

  • If the grievance is not resolved satisfactorily to the Union after the hearing before the Board (Fourth Stage), there shall be a fifth step of impartial arbitration.

  • The parties agree to continue past practice for the use of Ushers at events held at Fourth Stage.

Related to Fourth Stage

  • Stage means level of progress of the works identified as such and more particularly described in the Employer’s Requirements for which a Key Date for the achievement thereof is stipulated in the Contract.

  • Phase III means a human clinical trial of a Licensed Product, which trial is designed to: (a) establish that a Licensed Product is safe and efficacious for its intended use; (b) define warnings, precautions and adverse reactions that are associated with the Licensed Product in the dosage range to be prescribed; (c) support regulatory approval of such Licensed Product; and (d) be generally consistent with 21 CFR § 312.21(c). Said trial may be conducted in any country.

  • Phase 2 means the phase of the ATP comprised of: (1) improvements to the State Street Substation to receive Rebuilt Line 972; (2) the rebuilding of NYSEG’s existing Line 972 not performed in Phase 1; (3) construction of Relocated Line 15; (4) the construction of Bused Line 5; (5) improvements to the Elbridge Substation to receive Relocated Line 15; and (6) improvements to the Elbridge Substation to receive Bused Line 5.

  • Construction Completion Date or “Completion Date” means the date by which the overall Development of the Project is completed in accordance with the provisions of this Agreement and when the Completion Certificate is issued by the Authority as per Article 14.1.

  • Second Incremental Auction means an Incremental Auction conducted ten months before the Delivery Year to which it relates.
