Labour Court definition
Labour Court means the Labour Court established by section 151 of the Labour Relations Act;

As provided for in the Employment Equity Act, employers may approach the Labour Court to obtain authorisation for testing.
An employee cannot be compelled to undergo an HIV test or to disclose his or her HIV status as part of such proceedings unless the Labour Court authorised such a test.
HIV testing by or on behalf of an employer may only take place where the Labour Court has declared such testing to be justifiable in accordance with Section 7(2) of the Employment Equity Act.
