The Employer agrees to designate reasonable space labeled with the Union’s name on four bulletin boards in the following locations: two in the Municipal Building, (one of which is located in the Police Department), one in the Library Building and one in the Public Works Department.
The District agrees to consider this possible expansion of the Library Building in the initial design phase of the Library Building so as to accommodate a potential future addition.
In addition, on or before July 1, 2018, the Library will reclassify an existing Library Building Custodian position to a Senior Building Custodian position.
This Agreement represents a license that is limited in purpose and scope to the times, uses and space in the RPL’s Central Library buildings, the ▇▇▇▇▇▇▇ Memorial Library Building and the Bausch & Lomb Public Library Building, described herein and does not represent a lease or create any interest in the property other than as specifically identified and described in this Agreement.
Development of the New Library Site and design and construction of the Library Building shall be subject to the development plan review process and approval by the Town’s Planning and Community Development Commission (“PCDC”), in accordance with all applicable procedures set forth in Article 17 of Chapter 16 of the Lyons Municipal Code (“Site Plan and Development Plan Review Process”).
Said Exclusive Use shall also include an exclusive license to maintain and operate café kiosks and vending machines at the Library Building, provided, however, that no such kiosk or vending machine shall be installed or operated without the prior written consent of the City for each such kiosk or vending machine.
Notwithstanding the foregoing, the parties acknowledge that the Library Building is owned by the City and is generally exempt from the assessment of real estate taxes.
The City makes no representations as to the availability of utilities at the Library Building or for the Cafe.
Meeting room policy and procedures will be determined by the District after the Library Building is designed and will include designating a small meeting area for use by Town Boards and Commissions and access to the larger community room for occasional Town Hall-style public meetings.
In recognition of the considerable organizational and financial assistance provided by the Town to the District, the District agrees to make available to the Town on a to-be-determined preferential basis, use of meeting rooms in the Library Building.
