Litigation Matter definition

Litigation Matter means any Legal Proceedings set forth in Section 2.4 or Section 3.14 of the Company Disclosure Schedule.

Litigation Matter means that certain litigation styled Eli Lilly and Company vs. Emisphere Technologies, Inc., filed on December 2, 2003 in the United States District Court for the Southern District of Indiana, Indianapolis Division, together with any counterclaims therein and any and all appeals of any ruling or judgment with respect thereto.
