Major Deception definition

Major Deception means an act, representation or omission that materially affects the value of the Vehicle and, having regard to all of the circumstances, would reasonably be regarded as misleading, unprofessional, or unethical.
Major Deception means an act, representation or omission that, having regard to all of the circumstances would reasonably be regarded as misleading, unprofessional, or unethical and includes, but is not limited to, the failure to make a Declaration which materially affects the value of the Vehicle.

Examples of Major Deception in a sentence

  • Arbitration is not available except for Major Deception by Seller.White1: Auction is not in possession of the Vehicle’s ownership/registration documents on sale day and/or the Vehicle was previously registered in another province.

  • For all Online Vehicle Sales, in the absence of a Post‐Sale Inspection, if the arbitrator determines that the sale should be cancelled, (except for Seller’s Major Deception) the online Buyer’s remedy will be limited to the purchase price of the Vehicle.

  • Regardless of the light under which the Vehicle ran, the Vehicle listing category, or the limits on arbitration as stated in these Policies, the Auction reserves the right to allow arbitration and/or suspend a Customer’s auction privileges where the Customer has engaged in Major Deception.

  • A Major Deception ruling is at the sole discretion of the Arbitrator and is difficult to prove as it requires the seller to have knowingly committed the act, representation or omission.

  • For all Online Vehicle Sales, in the absence of a Buyer Protection Plan inspection, if the arbitrator determines that the sale should be cancelled, (except for Seller’s Major Deception) the online Buyer’s remedy will be limited to the purchase price of the Vehicle.

  • Accordingly, XxxxxXxx reserves the right to allow for arbitration notwithstanding the entries in the table below if TradeRev determines that the Seller has engaged in Major Deception.

  • The Auction reserves the right to assess an Arbitration Fee against the Buyer and/or Seller for Major Deception, or arbitration claims not made in good faith.

  • Major Decision means:

  • Massive Multiauthor Collaboration Site (or “MMC Site”) means any World Wide Web server that publishes copyrightable works and also provides prominent facilities for anybody to edit those works. A public wiki that anybody can edit is an example of such a server. A “Massive Multiauthor Collaboration” (or “MMC”) contained in the site means any set of copyrightable works thus published on the MMC site.
