The Trust Company and the Charterer each shall have certified that it is a “citizen of the United States” qualified to engage in the coastwise trade within the meaning of Section 2 of the Shipping Act, and the Owner Participant shall have certified that it is a Maritime Citizen pursuant to clause (ii) of the definition thereof.
Other than the undertakings and obligations of the Owner Participant in this Section 5.6, neither Owner Participant nor Shipowner shall have any obligation under any circumstances whatsoever to any of the Obligors or any other Person by reason of the cessation of the status of the Owner Participant as a Maritime Citizen, and no such cessation shall in any way diminish or adversely affect the obligations of any Obligor under any provision of this Agreement or any of the other Transaction Documents.
