Material Duties definition

Material Duties means the duties generally required by employers in the national economy of those engaged in a particular occupation that cannot be reasonably modified or omitted. In no event will working an average of more than 40 hours per week be considered a Material Duty.

Examples of Material Duties in a sentence

  • If you are a physician or dentist and have limited your Regular Occupation to the performance of the Substantial And Material Duties of a single specialty recognized by the American Board of Medical Specialties (ABMS) or American Osteopathic Association Bureau of Osteopathic Specialists (AOABOS) or American Dental Association (ADA), then that specialty will be deemed your Regular Occupation.

  • This rider changes the definition of Total Disability/Totally Disabled in the policy’s BENEFIT FOR TOTAL DISABILITY section to read as follows: • you are unable to perform the Substantial And Material Duties of your Regular Occupation; and • you are receiving Regular Medical Care from one or more Physician(s) appropriate for your Injury or Sickness.

  • This rider changes the definition of Total Disability/Totally Disabled in the policy’s BENEFIT FOR TOTAL DISABILITY section to read as follows:  you are unable to perform the Substantial And Material Duties of your Regular Occupation; and  you are receiving Regular Medical Care from one or more Physician(s) appropriate for your Injury or Sickness.

  • Thereafter, you will be considered Disabled if, as a result of sickness or bodily injury, you are unable to perform the Essential and Material Duties of any occupation for which you are reasonably fitted, or could so become, by education, training or experience and are not for wage or profit except as part of a rehabilitation program.

  • The attending Physician must be able to provide objective medical evidence to support his/her opinion as to why you are not able to perform the Material Duties of your Own Occupation or Any Occupation.

  • Your inability to perform any of your Material Duties because of preventive treatments or other preventive measures does not, by itself, constitute a Disability.

  • After your Own Occupation Period ends, Disability and Disabled mean you are, as a result of Physical Disease, Injury, Mental Disorder, Substance Abuse or Pregnancy, unable to perform one or more of the Material Duties of Any Occupation, and, due to such inability, your Work Earnings are less than 80% of your Indexed Predisability Earnings, and you are incapable of earning 80% or more of your Indexed Predisability Earnings.

  • This rider changes the definition of Total Disability/Totally Disabled in the policy’s BENEFITS FOR TOTAL DISABILITY section to read as follows: • you are unable to perform the Substantial And Material Duties of your Regular Occupation; and • you are not engaged in any other job or occupation for wage or profit; and • you are receiving Regular Medical Care from one or more Physician(s) appropriate for your Injury or Sickness.

  • Disability or Disabled means that during the Elimination Period and your Own Occupation Period you are, as a result of Physical Disease, Injury, Mental Disorder, Substance Abuse or Pregnancy, unable to perform one or more of the Material Duties of your Own Occupation, and, due to such inability, your Work Earnings are less than 80% of your Indexed Predisability Earnings, and you are incapable of earning 80% or more of your Indexed Predisability Earnings.

  • You will be considered Disabled during the elimination period shown in the Summary of Benefits and the next months if, as a result of sickness or bodily injury, you are unable to perform the Essential and Material Duties of your regular occupation and are not for wage or profit except as part of a rehabilitation program.

Related to Material Duties

  • Material and Substantial Duties means responsibilities that are normally required to perform your Own Occupation, or any other occupation, and cannot be reasonably eliminated or modified.

  • Duties includes obligations.

  • Performing means (a) with respect to any Portfolio Investment that is debt, the issuer of such Portfolio Investment is not in default of any payment obligations in respect thereof, after the expiration of any applicable grace period and (b) with respect to any Portfolio Investment that is Preferred Stock, the issuer of such Portfolio Investment has not failed to meet any scheduled redemption obligations or to pay its latest declared cash dividend, after the expiration of any applicable grace period.

  • Business Activities shall be deemed to include any activities which are included in the Company's Business now or during the effective period of this Agreement.

  • Responsibilities means the responsibilities delegated to BNY under the Rule as a Foreign Custody Manager with respect to each Specified Country and each Eligible Foreign Custodian selected by BNY, as such responsibilities are more fully described in Article III of this Agreement.
