Release of the Newborn Stem Cells may be prohibited by federal and/or state law due to contamination status, the presence of communicable disease in the Maternal Blood Sample or any other reason.
Where a pregnancy is assisted by surrogacy, the Maternal Blood will need to be collected from the Surrogate Mother.
Should the Maternal Blood not be collected at birth and couriered with the Cord Blood and/or Cord Tissue or should there be insufficient blood and additional Maternal Blood is required, the costs of withdrawing the Maternal Blood and couriering it (separately from the Cord Blood and/or Cord Tissue to the Netcells laboratory, will be for the Client’s own account.
The Maternal Blood sample must be drawn at the time of delivery independent of previous infectious disease and/or HIV testing which may have been done during pregnancy.
In the event of Maternal Blood found to be unfit or insufficient or not provided, LifeCell will notify the Client immediately and seek another collection.
Included in the Banking & Storage Fee in Clause 10.1.2 above, is the cost for the testing of Maternal Blood.
As per the statutory regulations, if the Maternal Blood is not provided within 7 days before or after childbirth, the Child’s Specimen can be used only for autologous purposes.

Birth Mother consents and agrees to the testing of the Maternal Blood as referenced in this Agreement and consents and agrees to the release of the test results to the Client.
The Client also understands that some portion of the Maternal Blood would be stored in special cryo-vial, in case needed, for future testing requirements.
