Examples of New Surveys in a sentence
Buyer shall be responsible for all costs associated with the New Surveys.
Seller shall receive a signed original of the final New Surveys as soon as it is available and in any event, at or prior to Closing.
The New Surveys shall be certified to Seller, Buyer, and the Title Company.
In the event Buyer commissions new surveys of the Property (the “New Survey”), then Seller shall provide all cooperation reasonably requested by Buyer regarding the preparation of the New Surveys.
The Due Diligence Period shall not be extended for resolution of any such matters in the New Surveys.
Buyer shall, promptly following the execution of this Agreement, commence to use its best efforts to obtain the New Surveys as soon as practicable.
Buyer may, at or prior to Closing, notify Seller in writing (the “Gap Notice”) of any objections to title raised by the Title Company after Buyer’s receipt of the initial Title Commitments, or of any material defect shown on the New Surveys that was not disclosed on the Existing Surveys; provided that Buyer must notify the Seller of such objection to title within ten (10) days of being made aware of the existence of any such new objection.
Purchaser and the Sellers shall split evenly the costs for the New Surveys.
At Purchaser's request, Sellers have ordered new or updated surveys for the Properties (the "New Surveys", and together with the Existing Surveys, the "Surveys").
Notwithstanding the foregoing, if Buyer elects to obtain an updated Title Commitment or updated Survey(s) or New Survey(s), then buyer shall have ten (10) days from the receipt of the latter of the updated Title Commitment, updated Survey, or New Survey to provide its Title Objections to the Seller.
