Nonconforming Goods means only the following: (i) product shipped is different than identified in Buyer's purchase order; or (ii) product's label or packaging incorrectly identifies its contents.

Nonconforming Goods means not conforming to the Product Warranty under Section 8.1 or any Goods received by Buyer from Seller pursuant to a Purchase Order that do not conform to the agreed upon Specifications in the corresponding Quote for the applicable Purchase Order. Nonconforming Goods means any goods received by Buyer from Seller pursuant to an Order that: (i) do not significantly conform to the specifications listed in the applicable Order; or (ii) materially exceed the quantity of Goods ordered by Buyer pursuant to this Agreement or any Order. Where the context requires, Nonconforming Goods are deemed to be Goods for purposes of this Agreement.

Crow Works’ limited warranty does not cover or apply to and in no event shall any repair, replacement or refund or credit be provided in the event of any of the following: 1) normal wear and tear; 2) defects occurring to the Goods after purchase, including without limitation defects due to any modification, intentional damage, accident, misuse, abuse, negligence;
Nonconforming Goods means any goods received by Distributor from Medizone under a Purchase Order that: (a) is not a Product; (b) does not conform to the specifications listed in the applicable Purchase Order; or (c) on visual inspection, Distributor reasonably determines are otherwise Defective.

Xxxxx acknowledges and agrees that the remedies set forth in this Section 4 are Xxxxx’s exclusive remedies for the delivery of Nonconforming Goods. Except as provided under Section 5, all sales of Goods to Buyer are made on a one-way basis and Buyer has no right to return Goods purchased under this Agreement to Seller.
