Nonconformities has the meaning set forth in Section 3.4.

Nonconformities means any failure or failures of the Hosted Service to conform to the requirements of Schedule A, this Agreement, Acceptance Criteria and/or any applicable Documentation. Each Nonconformity reported by HCS shall be classified according to a Severity level (as defined in Schedule E).

• Paragon shall endeavor to provide Corrected Versions on a timely basis in light of the severity of the Nonconformities existing at any particular time and the anticipated release of the next New Release.

• Prior to release of Product to finished goods inventory or release for Delivery to Prometheus, GSK shall test the Products for Nonconformities (as defined below), in accordance with the testing procedures described in the Specifications and the Quality Agreement and as otherwise required by cGMPs, Applicable Laws and Regulatory Acts.
