Old Spanish Trail Seismic means that certain Master Geophysical Data-Use License by and between Seismic Exchange Inc. and Falcon V dated February 19, 2008, as amended and supplemented from time to time.
As-Built Drawings and Specifications. A CADD-DXF file on CD-ROM, pdf versions of the drawings on CD-ROM, and a set of “Xerox” type blackline on bond prints of all “as-built” drawings and specifications of the Premises (reflecting all field changes and including, without limitation, architectural, structural, mechanical and electrical drawings and specifications) prepared by Tenant’s Architect and Engineers or by Contractors (defined below) shall be delivered by Tenant at Tenant’s expense to the Landlord within thirty (30) days after completion of the Tenant Work. If Landlord has not received such drawings and CD-ROM(s) within thirty (30) days, Landlord may give Tenant written notice of such failure. If Tenant does not produce such drawings and CD-ROM(s) within ten (10) days after Landlord’s written notice, Landlord may, at Tenant’s sole cost which may be deducted from the Allowance, produce such drawings and CD-ROM(s) using Landlord’s personnel, managers, and outside consultants and contractors. Landlord shall receive an hourly rate reasonable for such production.
Historic building means a building, including its structural components, that is located in this state and that is either individually listed on the national register of historic places under 16 U.S.C. 470a, located in a registered historic district, and certified by the state historic preservation officer as being of historic significance to the district, or is individually listed as an historic landmark designated by a local government certified under 16 U.S.C. 470a(c).
Single Phase Aerosol Air Freshener means an aerosol air freshener with the liquid contents in a single homogeneous phase and which does not require that the product container be shaken before use.
Campfire means a small outdoor fire intended for recreation or cooking not including a fire intended for disposal of waste wood or refuse.
MONTHLY KILOMETREAGE STATEMENT CUM BILL means the format specified by the Company.
Double Phase Aerosol Air Freshener means an aerosol air freshener with the liquid contents in two or more distinct phases that requires the product container be shaken before use to mix the phases, producing an emulsion.
Public School Student Accessing Courses at a Distance means a student who is scheduled for a full course load through the District and attends all classes virtually.
Safety Management Certificate has the meaning given to it in the ISM Code.
Leash means attaches the bird to the perch or falconer's glove.
Operating pressure means the pressure at which the parts of an irrigation system are designed by the manufacturer to operate.
Water Surface Elevation (WSE means the height, in relation to NAVD 1988, of floods of various magnitudes and frequencies in the floodplains of riverine areas.
Tourism destination project means a qualified non-gaming business facility that will be among the most visited privately owned or operated tourism or recreation sites in the State, and which is located within the qualified incentive area and has been determined by the authority to be in an area appropriate for development and in need of economic development incentive assistance, including a non-gaming business within an established Tourism District with a significant impact on the economic viability of that District.
Environmental Infrastructure System means the Environmental Infrastructure Facilities of the Borrower, including the Project, for which the Borrower is receiving the Loan.
Combustion turbine means an enclosed fossil or other fuel-fired device that is comprised of a compressor, a combustor, and a turbine, and in which the flue gas resulting from the combustion of fuel in the combustor passes through the turbine, rotating the turbine.
Site Assessment means a Site Assessment as defined in Paragraph 10(c).
Ambient air means that portion of the atmosphere, external to buildings, to which the general public has access.
Houseboat means watercraft primarily used as habitation and not used primarily as a means of transportation.
public open space means the securing of an area of a site at grade or street level which is acceptable to the City and is appropriately landscaped for the use and enjoyment of the public during reasonable hours.
Environmental Site Assessment means a Phase I environmental report meeting the requirements of the American Society for Testing and Materials, and, if in accordance with customary industry standards a reasonable lender would require it, a Phase II environmental report, each prepared by a licensed third party professional experienced in environmental matters.
Bathroom and tile cleaner means a product designed or labeled to clean tile or surfaces in bathrooms. “Bathroom and Tile Cleaner” does not include “Toilet/Urinal Care Product.”
Intermodal Rail Yard means a rail facility in which cargo is transferred from drayage truck to train or vice-versa.
System with a single service connection means a system which supplies drinking water to consumers via a single service line.
Sailboat means the same as that term is defined in Section 73-18-2.
Construction and Demolition Debris means and includes:
Plant Site (Works, Factory) means the local integration of one or more plants, with any intermediate administrative levels, which are under one operational control, and includes common infrastructure, such as:
Construction Phase Services means the coordination, implementation and execution of the Work required by this Agreement, which are further defined in Article 8.
