OTC Product definition

OTC Product means a pharmaceutical product for use in humans that has been approved by the FDA for sale to customers and/or patients in the Agreement Territory without a prescription.
OTC Product means any pharmaceutical product for therapeutic use in humans containing fluvastatin as the sole pharmaceutically active substance or in combination with one or more active substances that can lawfully be sold to customers and/or patients without being prescribed by Professionals.
OTC Product means OTC derivative products which may include equity options (including options over baskets of shares and indices) or bond options or any derivatives which may subscribed or purchased by the Client pursuant to the T&Cs for OTC Derivatives.

  • Novartis retains the right, at its sole discretion, to commercialize or to have commercialized any OTC Product during Agreement Year 2005 without any payment obligation to Reliant for such commercialization, except as expressly set forth in this Agreement.

  • CLIENT may terminate this Agreement upon 30 days’ prior written notice if the FDA causes the withdrawal from the market, approves any topical NSAID OTC Product, or restricts the use of VOLTAREN® in the Field or any other indication approved by the FDA and for which CLIENT is authorized to commercialize VOLTAREN® under the Novartis Agreement, or there is an imposition of restrictive federal and/or state price controls such that an obvious and substantial loss of sales for VOLTAREN® would result.

OTC Product means a pharmaceutical product for use in humans that has been approved by the FDA for sale to customers and/or patients in the Territory without a prescription. For the avoidance of doubt, a BTC Product shall constitute an OTC Product.
