Outdoor Market definition

Outdoor Market means a temporary outdoor retail operation that may be compromised of multiple vendors and temporary accessory structures in which agricultural, food, or art and craft products are sold, and occurs on a regular weekly basis, but no more than 3 days in a 7 day period, such as a farmer’s market or a flea market, but does not include any market operating pursuant to a Town permit or contract. Outdoors markets do not include garden centres;
Outdoor Market means a lot of part thereof, occupied for a temporary period by a collection of booths, stalls, tents or other physically defined areas, in a outdoor setting, for the retail sale of goods and/or foodstuffs by tow or more individual vendors and operated with the approval and consent of a Business Improvement Area Board of Management.(Added By-law 147-2007 dated July 30, 2007.)
Outdoor Market means any meeting or assembly where persons are permitted or invited to offer new or used merchandise, articles or things of value for sale or exchange on premises other than their own which are made available at certain times for such sales or exchanges. Outdoor Market means a business that, for a fee, permits individuals to use or occupy a space, table or booth outdoors on public property for the purpose of retail marketing of goods or services and for which purpose an agreement with the City authorizes that use of the public property;

This operation must occur on private property with written consent from the owner or on public property with written consent of the governmental entity under whose jurisdiction said property exists, and no foods may be sold, offered for sale or exposed for sale on any portion of the property that is located within one hundred feet of the closest edge of the paved portion of an arterial as that term is defined and used in Section 13.20.040 of this code. A proper health permit must be acquired. The establishment shall not be permanent.
