This Agreement (or its Attachments) may be amended upon request of any Participating Regulator or the Companies, provided that such amendment does not materially alter this Agreement.
Such amendment requires a majority vote of the Monitoring Regulators and agreement by the Companies but does not require the consent of any Participating Regulator.
In order to be legally required, the term must be specified by statute, regulation, bulletin or other interpretive document, or case law and the statute, regulation, bulletin or other interpretive document, or case law must further require the inclusion of the term in an agreement between the Participating Regulator and its regulated entities.
For purposes of this Agreement, an “Applicable Consent Order” shall be satisfactory to the Companies if it: (i) incorporates by reference and attaches via exhibit a copy of this Agreement, (ii) expressly adopts and agrees to the provisions of this Agreement, and (iii) includes only those other terms that may be legally required in the jurisdiction of the applicable Participating Regulator.
If a Signatory Regulator finds that applicable state law, regulation or procedure requires the preparation and execution of a consent order in order to carry out the terms of this Agreement, such a consent order (the “Applicable Consent Order”) will be prepared by the Participating Regulator within 60 days following the Effective Date.
An Electricity Safety Regulator of a participating jurisdiction (a Participating Regulator) may apply for an EESS Grant by submitting a Grant Request or Requests to the SCO Secretariat in the form required by the SCO Secretariat and that satisfies the requirements below.
Each Participating Regulator by way of signature below gives his/her express assurance that under their applicable state laws, regulations and judicial rulings, they have the authority to enter into this Regulatory Settlement Agreement.
Nothing in this Agreement and Protocol shall prohibit a Joint Examination Participating Regulator from choosing to withdraw from a Joint Examination and conduct a Concurrent Examination.
The MDCC will designate an Examiner-in-Charge (“EIC”) for each Joint Examination Team, giving first priority to a Home Participating Regulator or volunteers from Participating Regulators.
Participating Regulators shall endeavor to support the work of the MDCC and the Coordinated Goals of this Agreement and Protocol to the extent possible, as appropriate to the resources available to the Participating Regulator and the benefits derived by the Participating Regulator from this Agreement and Protocol.
