Perpetual Use. Notwithstanding anything else in the Agreement, Suweco grants to NTK and Participating Institutions a nonexclusive, royalty-free, system-wide perpetual right limited to the territory of Czech Republic to use any Materials that were subscribed to or for which a perpetual usage Fee has been paid during the term of this Agreement. Such use shall be in accordance with the provisions of this Agreement, which provisions shall survive any termination of this Agreement. The means by which NTK and/or Participating Institutions shall have access to such Materials shall be in a manner and form substantially equivalent to the means by which access is provided under this Agreement. If the Suweco’s means of access is not available, the NTK and/or Participating Institutions may provide substantially equivalent access to the Materials by use of an archival copy or by engaging the services of third-party trusted archives (such as Portico) and/or participating in collaborative archiving endeavors to exercise its perpetual use rights. Archival Copy. Suweco shall provide to NTK upon request, or NTK may create, one (1) copy of the entire set of Materials to be maintained as an archival copy. The archival copy from the Publisher shall be provided without any DRM in a mutually agreeable medium suitable to the content, and any fees for provision of copies will be on a time and materials basis only.

Perpetual Use. After termination of this Agreement the Publisher will provide each terminating Licensee and its Authorised and Walk-in Users with access to that part of the Licensed Materials published within the subscription period, as detailed in Schedule 2, as applicable to each individual Licensee. This shall be accomplished either by continuing online access to the same material on the Publisher’s server or a third party server including Portico. Licensee may also gain perpetual access via the LOCKSS system. Perpetual access and use shall be free of charge and is subject to the terms and conditions of this Agreement. Perpetual access will not be provided to the Licensee nor their Authorised Users where the Agreement has been terminated due to a breach by that particular Licensee. Furthermore, after termination of this Agreement, where the Publisher has granted perpetual access to any terminating Licensee and its Authorised and Walk in Users under separate Agreements, the Publisher agrees that:
(i) the permitted and prohibited uses in respect of that access will be the permitted uses and prohibited uses stated in this Agreement in sections 3 and 4;
(ii) the Licensee’s obligations in respect of that access will be as stated in this Agreement in sections 7.1.1, 7.1.2 and 7.2.
Perpetual Use. Licensed Software that is lawfully purchased from an Approved Source and is not (i) a Subscription license, (ii) provided for Non-commercial Purposes (defined below), or (iii) otherwise limited to a finite term as indicated in an SSLA, if any, shall be deemed to have a Perpetual License Term. The Perpetual License Term will commence on the date that Juniper sends the associated License Entitlement to You or Your agent (including an Approved Source), if any.

Perpetual Use. The Publisher currently provides open, free electronic access to back issues of the Licensed Material, starting 12 months after publication of a Licensed Material issues. Should the Participating Institution cancel or fail to renew this Agreement, the Participating Institution will continue to have access to those Licensed Material journals from the purchased Publisher Licensed Material journals published during the agreement period in question. The Publisher makes the commitment to enable the Participating Institutions to have perpetual access to the Licensed Material journal content subscribed to.
