Customer shall update the Planned Projects on a monthly basis prior to the Commencement Date for the related Services.

Within one year in advance of the expiration of this PA, the Corps shall review all the Planned Projects that have occurred and any past, present, and reasonably foreseeable future actions that have or will occur at the Salton Sea within the APE and determine if the Undertaking has had an adverse cumulative effect on historic properties and, if it has, if those adverse effects have been adequately resolved through previous mitigation that occurred as part of this PA.
Planned Projects: Specific times, dates, and requirements must be agreed upon by MZI and ALS no later than 72 hours prior to project start time.
TXU shall not be permitted to insource or resource any of the scope or volume of Services being provided by the Transitioned Employees as of the Master Agreement Effective Date; provided, however, that subject to Section 4.3(b), TXU shall be permitted to insource or resource services that replace the scope and volume of Planned Projects after such Planned Projects are completed under this Agreement.
The Corps’ Section 106 obligation is fulfilled under this PA with respect to that Planned Project(s) and the Corps will document in the PA annual report, pursuant to Stipulation XVII.
Consulting Parties are a subset of Consulting Parties and are those parties whom the Corps has identified as having a consultive role for a Planned Project and would include at a minimum any Cooperating Agency who has a federal action related to the specific planned project and has designated the Corps as LFA, the SSMP State Team, and any Federally and non- Federally recognized Tribes, that attach religious and cultural significance to historic properties that may be affected by a Planned Project(s).
