Phase 1 of the Planning Process will be entirely Tŝilhqot’in Nation-led and self-determined, according to its own internal processes and values.
Notwithstanding the foregoing, the deemed pursuit of the Tenure Continuation Path does not limit the ability of the Province and the Tŝilhqot’in Nation to continue the Planning Process for the Mineral Tenures Area (including, if applicable, for the later selection and implementation of the Conservation Path).

The Province and the Tŝilhqot’in Nation have collaboratively developed, completed and executed a “Pathways and Principles” document, attached as Schedule N, to guide the Planning Process (the “Pathways and Principles Document”).
The Province shall, with the Tŝilhqot’in Nation, make reasonable efforts to seek additional funding from the Government of Canada to support the implementation of this Agreement, including the Planning Process.
Nothing contained in Section 2.13 of this Agreement shall limit the right of the NTO to protest, comment on, or engage in litigation before FERC, the New York Public Service Commission, or any court with respect to proposed changes to the Reliability Planning Process.
