Portable Use definition

Portable Use means the private viewing by a consumer on a portable digital video player in non-public locations and, provided that the consumer’s use of the portable digital video player in such locations is personal, in public locations; provided, however, that any such viewing shall not constitute a “Portable Use” if the venue charges a fee for the viewing or for entrance into the venue for the sole purpose of the viewing, or if the viewing is on a public screen.
Portable Use means the private, non-commercial viewing of audio-visual programs by a customer on a portable digital video player in non-public locations and, provided that the customer’s use of the portable digital video player in such locations is personal and non- commercial, in public locations; provided, however, that any such viewing for which a premises access fee or other admission charge is imposed (other than any fee related only to access such non-residential venue for other general purposes) or any such viewing that is on a monitor provided by such non-residential venue (or by a third party under any agreement or arrangement with such non-residential venue) shall not constitute a “Portable Use.”

In addition, Lessor may (but without any obligation to do so) condition its consent to any Reportable Use of any Hazardous Substance by Lessee upon Lessee's giving Lessor such additional assurances as Lessor, in its reasonable discretion, deems necessary to protect itself, the public, the Premises and the environment against damage, contamination or injury and/or liability therefor, including but not limited to the installation (and, at Lessor's option, removal on or before Lease expiration or earlier termination) of reasonably necessary protective modifications to the Premises (such as concrete encasements) and/or the deposit of an additional Security Deposit under Paragraph 5 hereof.
