The Calculation Agent shall only deliver a Repudiation/Moratorium Extension Notice where it determines that Publicly Available Information exists confirming the existence or occurrence of the relevant Potential Repudiation/Moratorium.

Repudiation/Moratorium Extension Notice” means an irrevocable notice (which may be in writing (including by facsimile and/or e-mail) and/or by telephone) from the Calculation Agent to the Company that describes a Potential Repudiation/Moratorium that occurred on or prior to the Credit Observation End Date (determined by reference to Greenwich Mean Time (or, if the relevant Standard is Japan or Japan Sovereign, Tokyo time)).
An Event Determination Date may result from a Credit Event occurring at any time from and including the Credit Event Backstop Date to and including the Credit Observation End Date (or the Extension Date, if a Potential Failure to Pay or Potential Repudiation/Moratorium occurs).
