Proper Use definition

Proper Use means installation, commissioning, operation and maintenance in accordance with Sandvik’s relevant documentation; and (b) “defects” means any defect or omission in materials or workmanship and any nonconformity with the specifications for the Goods agreed in the Contract (excluding trivial or immaterial defects not affecting functionality or use).
Proper Use means use of the Proprietary Information solely by the recipient for the objectives of this Agreement.
Proper Use also means observing the correct procedures concerning set up, operation, maintenance and cleaning instructions.

Xxxxxxx’x liability to repair or replace damaged equipment shall not exceed the amount of warranty coverage set forth above, in the aggregate for the specific Xxxxxxx Product used. At your option, you may also receive a refund of the current depreciated value of the damaged equipment at the time of the occurrence not to exceed this limitation.
