Proposed Facility definition

Proposed Facility means a facility proposed to be constructed, installed or operated;

Proposed Facility means the new construction of a building for a facility, an addition or alteration to an existing building for a facility, or the change in use of a building for a facility;

Proposed Facility means a facility which has not qualified for interim status under WAC 173-303-805 or for which the department has not issued a final facility permit under WAC 173-303-806 prior to the effective date of this section;

• To the extent that Seller has constructed the Facility in accordance with Good Utility Practice, and met all other requirements under Section 3.4(b) of this Agreement, if the Independent Engineer’s certification provides that the Actual Facility Size exceeds the Proposed Facility Size as provided in Exhibit A, the Buyer’s Percentage Entitlement will be recalculated and replaced by the percentage derived by dividing the Contract Maximum Amount by the Actual Facility Size.

More Definitions of Proposed Facility
