Except as otherwise indicated, each capitalized term used herein shall have the meaning set forth for the same elsewhere in this Agreement. Without limitation on the other requirements set forth in this Agreement, any financing (the "Proposed Loan"), as well as the note (the "Proposed Note") evidencing the same and the deed of trust and other security instruments (collectively, the "Proposed Encumbrance") securing the same, must satisfy each of the requirements set forth in this Exhibit, except for any deviation therefrom specifically approved in writing by Investor.

Examples of Proposed Loan in a sentence

  • If a new Utilisation Request is received by the relevant Agent prior to the applicable Specified Time with a Proposed Loan equal to or less than, when aggregated with the Outstanding Facility Amount, to the Collateral Value shown in the Collateral Report, that relevant Agent shall advance the relevant funds received from the Lenders in an amount equal to the amount specified in the new Utilisation Request.
