Proposed Operator means the single purpose entity (which may exist, or may be incorporated during the Franchise Letting Process) that the Applicants propose will operate the Franchise if the Applicants are selected to do so;

  • If you have incorporated a single purpose entity for the purposes of your bid, this entity (the Proposed Operator) should also execute the agreement.

  • Promptly thereafter, Servicer and the applicable Licensee will furnish to such Proposed Operator current bank statements with respect to such accounts.

  • This Agreement shall extend to haul trucks owned by the Proposed Operator, its employees and agents as well as to third party trucking services.

  • If and to the extent that Manager or any Proposed Operator or any of their respective affiliates shall collect any account receivable owned (or deemed to be owned) by any Relevant IHS Entity, such person or entity shall immediately pay such amount to such Relevant IHS Entity, and until such payment is so made, Manager shall hold such amount in trust for the benefit of such Relevant IHS Entity.

  • Such Personnel shall be employees of Servicer (subject to the following sentence), provided Manager, Advisors and the Proposed Operator of the relevant Facility shall have full responsibility for payment of their wages, salaries, and other compensation and benefits (in accordance with Section 4).

  • If the invoice is not paid within thirty (30) days of the date of the applicable invoice, then this agreement shall be suspended and no further hauling by Proposed Operator or one acting on Proposed Operator's behalf shall occur until said invoice is paid in full.

Related to Proposed Operator

  • Licensed Operator means a person licensed, or deemed to be licensed, to provide a port service or operate a port facility;

  • Designated operational area means a geographic area designated by the combatant commander or subordinate joint force commander for the conduct or support of specified military operations.

  • market operator means a person or persons who manages and/or operates the business of a regulated market. The market operator may be the regulated market itself;

  • Non-Operator means a Party other than the Operator;

  • Qualified Operator means a Person that has at least five (5) years’ experience operating power generation and storage facilities generally similar to the Facility.
