Proration Event definition

Proration Event means an event that occurs when, based upon all valid Nominations submitted by Shippers in compliance with this Joint Tariff and by Local Tariff Shippers in compliance with the Local Tariff, Carrier determines that the total volumes nominated by all Shippers and Local Tariff Shippers for shipment on Carrier’s Pipeline or a pipeline segment thereof exceed the Available Capacity of Carrier’s Pipeline or a pipeline segment thereof.
Proration Event means any curtailment, shortage or cessation (i) in Holly’s existing or contemplated supply of Products from the Combined Plants or (ii) in the raw materials used to manufacture the Products (including any shortage of raw materials resulting from Holly’s decision not to purchase such raw materials due to Holly’s decision that the cost of available crude products are unreasonably high), irrespective of the cause or foreseeability of such curtailment, shortage, or cessation.
Proration Event has the meaning specified in Section 5.11(e).

Examples of Proration Event in a sentence

  • Notwithstanding the foregoing provisions of this Section 5(c), if you have incurred a Termination of Service that is a Proration Event before the date of a Change of Control, the number of Units subject to this Award as of such Change of Control shall be determined by multiplying the number of Units determined in accordance with the rules set forth in the preceding paragraphs of this Section 5(c) by the Proration Fraction.

  • Servicer Termination Event shall have the meaning assigned to such term in the Lead Securitization Servicing Agreement or at any time that the Mortgage Loan is no longer subject to the provisions of the Lead Securitization Servicing Agreement, any analogous concept under the servicing agreement pursuant to which the Mortgage Loan is being serviced in accordance with the terms of this Agreement.

  • Load Reduction Event means a reduction in demand by a Member or Special Member for the purpose of participating in the PJM Interchange Energy Market.
