Reformulation Commitment. As of the Effective Date all Products manufactured, imported, distributed, sold and/or offered for sale in the State of California by Xxxxxxx shall be Products that qualify as Reformulated Products as defined in Section 2.1.
Reformulation Commitment. As of the Effective Date, Xxx X’Xxxx shall not manufacture, import, distribute, sell or offer the Products for sale in the State of California unless they are Reformulated Products pursuant to Section 2.1 above or carry the Proposition 65 warnings specified in Section 2.3 below.
Reformulation Commitment. As of the Effective Date, Boss shall not manufacture, import, distribute, sell or offer the Products for sale in the State of California unless they are Reformulated Products pursuant to Section 2.1 above, or Products containing appropriate Proposition 65 warnings as described in Section 2.3 below.
Reformulation Commitment. As of the Effective Date, Homestead shall not manufacture, import, distribute, sell or offer the Products for sale in the State of California unless they are Reformulated Products pursuant to Section 2.1 above, or shall carry the Proposition 65 warnings specified in Section 2.3 below.
Reformulation Commitment. As of the Effective Date, Kikkerland shall not manufacture, import, distribute, sell or offer the Products for sale in the State of California unless they are Reformulated Products pursuant to Section 2.1.
Reformulation Commitment. Commencing on the Effective Date and continuing thereafter, all Products Mechanix manufactures, imports, sells, ships, or distributes for sale in or into California, directly or through one or more third party retailers or e-commerce marketplaces, shall meet the Reformulation Standard for Reformulated Products, as defined by Section 2.1.1. This Reformulation Commitment does not apply to any Product sold or distributed prior to the Effective Date.
Reformulation Commitment. On or before December 1, 2016 and continuing thereafter, Burmax agrees to only manufacture for sale or purchase for sale in or into California, “Reformulated Products”, or Products containing appropriate health hazard warnings as described in Section 2.2. will receive a properly tailored release from Held.
Reformulation Commitment. Any Products remaining in LR’s inventory after April 1, 2018, shall carry appropriate health hazard warnings for any Covered Products distributed, offered for sale or sold in California per section 2.3, below.
Reformulation Commitment. As of the Effective Date all Products manufactured, imported, distributed, sold and/or offered for sale in the State of California by Xxxxx shall be Products that qualify as Reformulated Products as defined in Section 2.1, or shall contain health hazard warnings as described in Section 2.3. The warning requirements in section 2.3 shall not apply to any Products manufactured, imported, distributed, sold, and/or offered for sale in the State of California before the Effective Date.
Reformulation Commitment. As of the Effective Date, 99 Cents Only shall not sell or offer the Products for sale in the State of California unless they are Reformulated Products pursuant to Section 2.1. This reformulation commitment shall not apply to those products in 99 Cents Only’s inventory on the Effective Date, as those products have been included in the calculation of civil penalties due pursuant to Section 3.1. The Parties agree and intend that compliance with the terms of this Settlement Agreement shall constitute compliance with Proposition 65 with respect to exposures to DEHP from the Products.
