Reliability Curtailment definition

Reliability Curtailment means any curtailment of Delivery of Energy resulting from (i) an emergency condition as defined in the Interconnection Agreement or the ISO- NE Tariff, or (ii) any other order or directive of the Interconnecting Utility or the Transmission Provider pursuant to an Interconnection Agreement or tariff.
Reliability Curtailment means any curtailment (a) made, initiated, directed or ordered by any ERO, the Host Utility, any market monitor, any Balancing Authority (including any ISO or RTO), any other Transmission Provider or any other Person other than Buyer (taking into account Section 1.5) or (b) resulting, in whole or in part, from any curtailment, limitation or shortcoming (including any scheduled or unscheduled outage) on, or other circumstance relating to, any transmission or distribution system, including emergencies or reliability events or conditions (even if any order, directive or other communication from any such Person is, or the occurrence of any such curtailment, limitation or shortcoming or circumstance condition is, communicated to Seller through Buyer).
Reliability Curtailment. Any curtailment of delivery of Qualified Renewable Energy into Zone J over the Associated New Transmission Facility that is required in response to (a) an emergency condition as defined in the NYISO tariff, or (b) any other order or directive of the interconnecting utility within Zone J or the provider of the Associated New Transmission Facility pursuant to an interconnection agreement or tariff.

Examples of Reliability Curtailment in a sentence

  • If Buyer fails to accept all or part of any of the Products to be purchased by Buyer hereunder, and such failure to accept (a) is not the result of Reliability Curtailment or (b) is not otherwise excused under the terms of this Agreement (a “Rejected Purchase”), then Buyer shall pay Seller, on the date payment would otherwise be due in respect of the month in which the failure occurred, an amount for such Rejected Purchase equal to the Resale Damages.

  • Notwithstanding anything to the contrary, Buyer shall have no obligation to pay for (and shall have no other liability for and shall not be considered in breach or default under this Agreement (and no Event of Default or Potential Event of Default of Buyer shall arise) as a result of) any Energy that, regardless of reason therefor (including Force Majeure or any Reliability Curtailment), has not actually been delivered to Buyer at the Injection Point, except to the extent set forth under Section 7.4.

  • A failure of the Biennial Average Real-Time High Operating Limit for any two consecutive Contract Years to be at least fifty percent (50%) of the Actual Facility Size, except to the extent excused by (i) a Force Majeure (without affecting Buyer’s right to terminate this Agreement under Section 10.1(c)), (ii) a Catastrophic Failure not caused by a Force Majeure, unless and until such Catastrophic Failure exceeds the duration of the Catastrophic Failure Period or (iii) a Reliability Curtailment.

  • Purchaser shall be responsible for all imbalance costs, operating reserves and congestion costs incurred at the Point of Delivery and for delivery of its Contract Capacity Share of the Renewable Energy at and from the Point of Delivery, excluding any such costs arising from the failure by Seller to curtail deliveries in connection with a Reliability Curtailment or, to the extent provided in Section 3 of Exhibit B, an Economic Curtailment.

  • In all cases of Reliability Curtailment, Seller shall reduce the net Energy delivered by the Facility at the Point of Delivery to the level directed by the Transmission Operator, the Transmission Provider or the Interconnection Provider, as applicable.

  • Except as provided in Section 5.1, no compensation shall be due from Purchaser to Seller as a result of any curtailment of the Facility’s generation arising from any Reliability Curtailment directed by the Transmission Operator, the Transmission Provider or the Interconnection Provider.

  • In the event that Seller fails to satisfy any of its obligations to Deliver any of the Products or any portion of the Products hereunder in accordance with Section 4.1, Section 4.2 and Section 4.7, and such failure is not excused under the express terms of this Agreement or the result of a Reliability Curtailment (a “Delivery Failure”), Seller shall pay Buyer an amount for such Delivery Failure equal to the Cover Damages for such Delivery Failure.

  • In the event of a Reliability Curtailment, Economic Curtailment, Force Majeure event, a Forced Outage, a Scheduled Outage/Derating or other planned or unplanned outage of the Facility, Seller shall allocate the curtailment ratably among purchasers of Facility output, by delivering to Purchaser its Contract Capacity Share of the non-curtailed level of output.

  • To the extent Energy is delivered contrary to the Economic Curtailment requirements of Exhibit B or any Reliability Curtailment, Purchaser shall pay for such Energy at the rates provided herein, but such purchase price shall be reduced by all net costs (including any positive difference between the Contract Rate and the LMP) incurred by Purchaser as a result of using or disposing of any Energy deliveries contrary to such Economic Curtailment requirements of Exhibit B or Reliability Curtailment.


More Definitions of Reliability Curtailment

Reliability Curtailment means any curtailment of the Project associated with an oversupply of generation on Buyer or the Transmission Provider's Transmission System during a period of time when generating facilities connected to the Transmission Provider's Transmission System are interrupted or reduced in an equitable and non-discriminatory manner. Reliability Curtailments shall be capped on a calendar year basis at Twenty-Five Thousand Three Hundred (25,300) MWh ("BAA Cap"), after which Buyer shall compensate Seller in an amount equal to the product of (i) the Energy Output Payment Rate plus the PTC Compensation Amount, multiplied by (ii) the Deemed Energy in excess of the BAA Cap that would have been delivered but for such Reliability Curtailment. lf any of the conditions set forth in this defmition are applicable, Buyer shall be rebuttably presumed not to be curtailing for economic reasons.
Reliability Curtailment means any curtailment of Delivery of Energy resulting from (i) an emergency condition as defined in the Interconnection Agreement or in the ISO-NE Tariff or the NYISO Tariff, or (ii) any other order or directive of the Interconnecting Utility or the Transmission Provider pursuant to an Interconnection Agreement or tariff for purposes limited to maintaining the reliability of the electric transmission network.
Reliability Curtailment means any reliability curtailment of the Project by the BAA or Transmission Provider due to any of the following reasons: (a) the Transmission Provider and/or BAA directs a general curtailment, reduction or redispatch of generation in the area for any reason other than any economic purpose or to accomplish least cost dispatch; (b) the BAA curtails or otherwise reduces the Metered Output in order to meet NERC/WECC standards criteria in regard to compliance obligations to the PNM Balancing Area and/or Transmission Provider’s Transmission System to operate within system limitations or other operating areas as directed by the Reliability Coordinator; or (c) for safety or equipment failure situations. Reliability Curtailment means any curtailment (a) made, initiated, directed or ordered by any ERO, the Host Utility, any market monitor, any Balancing Authority (including any ISO or RTO), any other Transmission Provider or any other Person other than Buyer (taking into account 39 NTD: If the Facility is registered in MISO as a Dispatchable Intermittent Resource, “Quantity Adjustment” will include Contract Energy that would have been provided but for MISO’s re-dispatch or reduction of the dispatch of the Facility in the MISO Real-Time Energy Market (excluding, for the avoidance of doubt, any Reliability Curtailment).
Reliability Curtailment means any curtailment of delivery of Renewable Energy resulting from (i) an Emergency, (ii) any other order or directive of the Interconnection Provider or the Transmission Operator, which order or directive may be directly communicated to Seller by the Interconnection Provider, the Transmission Provider or the Transmission Operator or indirectly to Seller by Purchaser promptly upon receipt thereof.
Reliability Curtailment means any curtailment (a) made, initiated, directed or ordered by any ERO, the Host Utility, any market monitor, any Balancing Authority (including any ISO or RTO), any other Transmission Provider or any other Person other than Buyer (taking into account Section 1.5) or (b) resulting, in whole or in part, from any curtailment, limitation or shortcoming (including any scheduled or unscheduled outage) on, or other circumstance relating to, any transmission or distribution system, including emergencies or reliability events or conditions (even 13 NTD: If the Facility is registered in MISO as a Dispatchable Intermittent Resource, “Quantity Adjustment” will include Contract Energy that would have been provided but for MISO’s re-dispatch or reduction of the dispatch of the Facility in the MISO Real-Time Energy Market (excluding, for the avoidance of doubt, any Reliability Curtailment). if any order, directive or other communication from any such Person is, or the occurrence of any such curtailment, limitation or shortcoming or circumstance condition is, communicated to Seller through Buyer).
