Sea Waybill definition

Sea Waybill means a receipt, evidencing the conclusion of a contract of carriage whereby delivery is made to the nominated consignee against proof of identity. This Sea Waybill is not transferable and not a document of title. If this document is issued and marked as Sea Waybill, these terms and conditions shall apply accordingly.

  • The Shipper, who is the only party entitled to give the Carrier instructions in relation to this contract of carriage, undertakes to provide the Merchant and in particular the Consignee with a legible copy of all the Terms and Conditions contained in this Sea Waybill.

  • Except as may be otherwise provided for herein, claims for loss, damage, delay or misdelivery of Goods transported hereunder shall be adjusted in accordance with, and Carrier’s liability shall be governed by this Contract, applicable Carrier’s tariff and Xxxxxxx’x Xxxx of Lading or Sea Waybill as applicable.

  • In the case of inconsistency between this Sea Waybill and the applicable Tariff, this Sea Waybill shall prevail.

  • The right of the Carrier to such indemnity shall in no way limit his responsibility and liability under this Sea Waybill to any person other than the Shipper.

  • Merchant acknowledges that Carrier does not own or operate ocean vessels and that, to the extent the transportation set forth on the face of this Bill of Lading entails transportation by water, a Bill of Lading or Sea Waybill is or may be issued by Actual Carrier(s) covering the transportation by water.

  • In the case of any conflict or inconsistency between this Sea Waybill and the applicable Tariff, it is agreed that this Sea Waybill shall prevail.

  • Notwithstanding anything else contained in or incorporated into this Bill, if it is issued as a Sea Waybill, it will not be a document of title to the Goods.
