Seller shall provide Buyer or Buyer’s designated agent in a timely fashion with all the data required to enable Buyer’s compliance with the U.S. Customs’ Importer Security Filing regulation, see 19 CFR Part 149 (the “ISF Rule”) for all of Seller’s ocean shipments of goods to Buyer destined for or passing through a U.S. port.
For all ocean shipments of Goods to Buyer, destined or passing through a U.S. port, Supplier shall provide Buyer or Buyer’s designated agent with accurate “Data Elements” for the U.S. Importer Security Filing regulation (the “ISF Rule”) to ensure Buyer or Buyer’s designated agent has sufficient opportunity to comply with its filing obligations.
Any party may partici- pate in ABI solely for the purposes of filing the Importer Security Filing pursuant to § 149.2 of this chapter if that party fulfills the eligibility re- quirements contained in § 149.5 of this chapter.
Supplier, its Affiliates and Representatives shall, if applicable, comply with United States Importer Security Filing (ISF) requirements, also known as 10+2, which requires Supplier to submit specific information for all its ocean shipments destined for US ports pursuant to US Customs Border Protection (CBP) regulations.
In addition, Supplier shall provide, in a timely, complete and accurate manner, to Buyer or Buyer’s designated agent, all data required to enable Buyer’s compliance with the U.S. Customs Importer Security Filing and additional Carrier Requirements regulation, 19C.F.R. Part 149 (the “ISF Rule”) for all of Supplier’s ocean shipments of Products to Buyer destined for or passing through a U.S. port, including the timely, complete and accurate provision of the ISF-10 Elements thereunder.
If a party other than a cus- toms broker as defined in § 111.1 of this chapter or an importer as defined in 19U.S.C. 1484 submits the Importer Secu- rity Filing, no portion of the Importer Security Filing can be used for entry or entry summary purposes pursuant to § 149.5 of this chapter.
Seller agrees it will comply with the obligations set out in (i) Trade Data and Customs Requirements for Suppliers and (ii) U.S. Importer Security Filing (10+2), both available at xxxx://xxx.xxxxxx.xxx/xxxxxxxxxxxx.xxx.
Seller acknowledges its obligation with respect to any goods intended for shipment to the United States to provide all required information in support of Buyer’s obligation under U.S. law to timely submit (i.e., more than 24 hours prior to ocean lading) its Importer Security Filing ("ISF") with U.S. Customs & Border Protection (“CBP”).
Supplier shall comply with Buyer’s standard operating procedures with respect to United States Customs Importer Security Filing (ISF) regulations, including, without limitation, timely cooperation with Buyer’s designated forwarder or customs agent, as applicable.
For imports into the United States, Supplier shall provide Buyer or Buyer’s designated agent in a timely fashion with all the data required to enable Buyer’s compliance with the U.S. Customs’ Importer Security Filing regulation, see 19 C.F.R. Part 149 (the “ISF Rule”) for all of Supplier’s ocean shipments of Goods to Buyer destined for or passing through a U.S. port.
