Separated Contract Price definition

Separated Contract Price means a Schedule of Values for the total sum payable by Owner as stated in Exhibit D for the Work (including all labor, supervision, all materials, and all Contractor Equipment) including overhead and profit, which sum shall be due in accordance with the terms of the Contract Documents as consideration for the timely performance of the Scope of Work to be performed by or through Contractor in order to complete the Project, all in strict accordance with the terms of the Contract Documents, which sum shall only be subject to adjustment in accordance with the Contract Documents.
Separated Contract Price means the price payable by the Owner under this Agreement for the Work (including all labor, all materials, and all equipment comprising the Facility), as stated in Exhibit J, as may be amended from time to time pursuant to the terms hereof. References to theEthanol Plant Price,” if any, contained herein, or in any Exhibit, attachment or other document relating to this Agreement, shall be deemed to be references to the Separated Contract Price.
Separated Contract Price has the meaning given to such term in the ------------------------ Construction Contract, which (after giving effect to the second amendment to the Construction Contract dated as of December 3, 2001 and the clarification letter to the Construction Contract dated as of January 11, 2002) is equal to $887,350,746.

Examples of Separated Contract Price in a sentence

  • All payments made under this Section shall be credited against the Separated Contract Price.

  • Except as expressly provided in herein, payments of the Separated Contract Price shall be made based on completion of Milestones in accordance with the Milestone Payment Table (“Milestone Payments”), subject to the terms and conditions hereof.

  • The following amounts, if any, that shall be payable to Contractor pursuant to the terms hereof are in addition to the Separated Contract Price: (i) interest payable on delayed payments by Owner hereunder; and (ii) sales tax reimbursement, if any, pursuant to Section 3.24.

  • Notwithstanding any dispute between Owner and Contractor regarding a proposed Change In Work, Owner Directive, Contractor’s claim regarding the impact of a change upon the Separated Contract Price or whether a Change In Work has in fact occurred, Contractor shall not suspend the Work unless directed by Owner in writing in accordance with Section 20.4, and Owner shall continue to make payments to Contractor based on the Schedule of Payment Values then in effect, pending resolution of such dispute.

  • If an event described in Section 16.1(i) occurs, the Separated Contract Price shall be adjusted by an amount equal to the Craft Labor Compensation Escalation Amount pursuant to a Change In Work reflecting such amount.

  • Once finally determined, the Separated Contract Price shall be changed only as expressly set forth in this Agreement.


More Definitions of Separated Contract Price

Separated Contract Price means the price for all labor, all materials, and all equipment as stated in Exhibit J as amended from time to time pursuant to the terms hereof.
Separated Contract Price means the total sum payable by Owner developed during the Open Book Review in accordance with Section 5.2 as stated in Exhibit BB for all labor, all materials, and all equipment, which sum shall be due in accordance with the terms of this Agreement as consideration for the performance of the Statement of Work to be performed by or through Contractor on a “turnkey” basis in order to complete the Project, all in strict accordance with the terms of this Agreement, which sum shall only be subject to adjustment in accordance with this Agreement.

Related to Separated Contract Price

  • Original contract price means the award price of the contract; or, for requirements contracts, the price payable for the estimated total quantity; or, for indefinite-quantity contracts, the price payable for the specified minimum quantity. Original contract price does not include the price of any options, except those options exercised at the time of contract award.

  • Contract Price means the price payable to the supplier under the contract for the full and proper performance of his contractual obligations.

  • The Contract Price means the price payable to the Supplier under the Contract for the full and proper performance of its contractual obligations.
