Special Unit Majority definition

Special Unit Majority means a majority of the Trust Units present in person or by proxy at a meeting at which a quorum is present. For the purposes of calculating a Special Unit Majority, abstentions and broker non-votes shall not be deemed to be a vote cast.
Special Unit Majority means (i) a majority of the Common Units (excluding Common Units owned by XxxxXxxxx and its Affiliates) present in person or by proxy at a meeting at which a quorum is present; provided, that, at any time when XxxxXxxxx and its Affiliates collectively own less than 10% of the outstanding Trust Units, “Special Unit Majority” means a majority of the Trust Units present in person or by proxy at a meeting at which a quorum is present.
