Specially Designated Mortgage Loan Documents. With respect to any Mortgage Loan, subject to Section 1.04, the following documents on a collective basis:

Specially Designated Mortgage Loan Documents is used to refer to documents actually received by the Trustee or by a Custodian on its behalf, such term, with respect to any receipt or certification by the Trustee or a Custodian on its behalf for documents described in clauses (iv) and (v) of this definition, shall be deemed to include such documents only to the extent the Trustee or a Custodian on its behalf has actual knowledge of their existence; and provided, further, that the only Specially Designated Mortgage Loan Document with respect to each of the Outside Serviced Trust Mortgage Loans shall be the document described in clause (i) of this definition.

Specially Designated Mortgage Loan Documents. With respect to any Mortgage Loan, subject to Section 1.04 of the Pooling and Servicing Agreement, collectively (i) the original executed Mortgage Note (or if the original executed Mortgage Note has been lost, a lost note affidavit and indemnity with a copy of such Mortgage Note), (ii) an original or a copy of the Mortgage, in each case (unless the particular item has been sent for recording but has not been returned from the applicable recording office) with evidence of recording indicated thereon; (iii) an original executed assignment, in recordable form, of the Mortgage in favor of the Buyer/Secured Party and (iv) such other documents as specified in the definition of “Specially Designated Mortgage Loan Documents” in the Pooling and Servicing Agreement.

Specially Designated Mortgage Loan Documents. With respect to any Trust Mortgage Loan, the following documents collectively: (i) the documents specified in clauses (i) and (vii) of the definition of "Mortgage File", (ii) the documents specified in clause (ii) of the definition of "Mortgage File" (with or without recording information), (iii) the documents specified in clause (ix) of the definition of "Mortgage File", and (iv) the original (or a copy if the original has been delivered to the Master Servicer or any Sub-Servicer therefor) of any letter of credit relating to the Trust Mortgage Loan; provided, that whenever the term "Specially Designated Mortgage Loan Documents" is used to refer to documents actually received by the Trustee or by a Custodian on its behalf, such term, with respect to any receipt or certification by the Trustee or a Custodian on its behalf for documents described in clauses (iii) and (iv) of this definition, shall be deemed to include such documents only to the extent the Trustee or a Custodian on its behalf has actual knowledge of their existence.

Specially Designated Mortgage Loan Documents means:

Specially Designated Mortgage Loan Documents is used to refer to documents actually received by the Trustee, such term shall not be deemed to include such documents and instruments referred to in CLAUSE (A) or CLAUSE (B), as applicable, of this definition unless they are actually so received.

Specially Designated Mortgage Loan Documents is used to refer to documents actually received by the Custodian, such term, with respect to any receipt or certification by the Custodian for documents described in clauses (iv) and (v) of this definition, shall be deemed to include such documents only to the extent the Custodian has actual knowledge of their existence; and provided, further, that the only Specially Designated Mortgage Loan Document with respect to the Georgia-Alabama Retail Portfolio Trust Mortgage Loan shall be the document described in clause (i) of this definition.
