Seller shall provide Buyer with a Commitment for Title Insurance (the “Commitment”) issued by the Title Company showing merchantable title in Sellers to the Property, subject however to Standard Policy Exceptions stated in the Commitment, instruments filed of record, easements of record and visible easements.
The Title Commitment shall also commit the title company, at Seller's expense, to delete the preprinted Standard Policy Exceptions, except as they pertain to the leasehold interests included as Permitted Encumbrances, subject to delivery to the title company of such instruments, documents, indemnities and releases as the title company shall reasonably require.
If the Title Commitment contains any liens and exceptions other than Permitted Encumbrances or Standard Policy Exceptions, Purchaser shall notify Seller of such exceptions in writing within ten (10) days of the date on which Purchaser has received both the Title Commitment and the Survey, and Seller shall have ten (10) days from the date of such notification to eliminate such exceptions or to obtain an endorsement to the Title Commitment removing them.
