The City shall provide the Developer with the storm water mitigation credits that are reasonably necessary for the filling of the pond on the Storm Water Detention Pond Area and creating the Surface Parking Lot on the Storm Water Detention Pond Area at current standard City rates.
This provision shall not be construed to allow the Village to erect any structure of permanent nature on the land of the Owner outside of the Storm Water Detention Pond, and in no event shall this Agreement be construed to impose any such obligation on the Village.
