The Owner agrees to implement the transportation demand management policies, measures, and improvements (''TDM Measures'') associated with the Project in accordance with the Traffic Impact Study prepared by MDM Transportation Consultants, Inc., dated March 9, 2020, as amended through the Planning Board Site Plan Review in connection with the Project, as attached hereto as Attachment A.
The purpose of the Transportation Monitoring and Annual Report is to provide BTD an update on transportation related issues, such as the performance of TDM Measures.

The independent auditor will provide the applicant, DelDOT, the Department and WILMAPCO annual audits on the progress of the applicant’s implementation of the TDM Measures in the TM Agreement and achievement of the trip reduction goals.
Developer shall, in consultation with qualified transportation engineers, design a bi-annual survey of residents' and employees' travel behavior as set forth below, conduct the survey and submit a written report ("TDM Report") on the status of implementing all TDM Measures, at no cost to the City.
