Third Party Results definition

Third Party Results means any scientifically valid methods, data, outcomes or other results (i) made in the course of the conduct, or resulting from the performance, of research conducted by members of the CHDI Research Group (as defined in Section 7(a) of this Agreement) (other than the Research Institution and the Researcher) and (ii) funded by the Foundation or one of its affiliates.

  • The Parties acknowledge that it is the intention of the Foundation, the Research Institution and the other members of the CHDI Research Group that the sharing of Results and Third Party Results among members of the CHDI Research Group is to be conducted in a manner so that such sharing shall not constitute "disclosure" for patent purposes.

  • If Consortium Partner(s) or their Affiliates need to use the Results of a Third Party for use or commercial exploitation of their own Results of the 6G-XR Project, each Third Party shall grant a non-exclusive, transferable right of use with regard to Third Party Results royalty-free conditions.

  • For the avoidance of doubt, such member shall be bound and obligated to treat any Results disclosed to such member in the same manner and extent as the Company is bound and obligated to treat any Third Party Results disclosed to the Company under Section 9(d).

  • The Foundation may disclose Project Results to any member of the High Q Research Group who has agreed in writing that each of the covenants applicable to Third Party Results set forth in Section 6(c)(ii)(A) through Section 6(c)(ii)(D) of this Agreement are also applicable with respect to any Project Results disclosed to such member, and such member of the High Q Research Group agrees to be bound by such covenants.

  • For the avoidance of doubt, such member shall be bound and obligated to treat any Results disclosed to such member in the same manner and extent as the Company is bound and obligated to treat any Third Party Results disclosed to the Company under SECTION 6(d).

  • All results developed solely by the Third Party(ies) during the sub-project ("Third Party Results") shall remain exclusively the property of the Third Party(ies).

  • In the event of any error or omission in the Third Party Results being brought to the attention of the Third Party by the Coordinator or the other ▇▇▇▇▇▇ Beneficiaries, the Third Party undertakes to correct such error or rectify such omission promptly, during which time the Coordinator shall be entitled to withhold payment of any sums due to the Third Party.

  • The Linked Third Party shall grant a non-exclusive , royalty-free and transferable right of use with the right for sub-licensing to Plan4all for implementationof the S4A11Cities project with regard to all results achieved by the Linked Third Party in the course of the work according to this Linked Third Party Agreement ("Linked Third Party Results ") and the background of the Linked Third Party related to these.

  • Third Party Reports With respect to any Mortgaged Property, the related Appraisal, Phase I environmental report, Phase II environmental report, seismic report or property condition report, if any.

  • Third Party Data has the meaning set forth in Section 9.3(a).
