Trust Income definition

Trust Income has the meaning set forth in the Trust Agreement.
Trust Income means, for any taxation year of the Trust, the amount by which the income of the Trust for such taxation year, computed in accordance with the provisions of the Tax Act (but without reference to paragraph 82(1)(b) and subsection 104(6) thereof) and taking into account such other amounts and adjustments as are determined in the discretion of the Trustees regarding the calculation of income for the purposes of determining the “taxable income” of the Trust, exceeds each amount determined by the Trustees in respect of any non-capital loss for a prior taxation year that the Trust is permitted by the Tax Act to deduct in computing the taxable income of the Trust for such year; provided, however, that capital gains and capital losses will be excluded from the computation of the Trust Income.
Trust Income means the income of the trust for any taxation year of the Fund will be the income for such year computed in accordance with the Tax Act less, at the discretion of the Trustees, amounts of any non-capital losses of the Fund for the prior years that are deductible in computing the Fund’s taxable income for the year under the Tax Act; provided, however, that capital gains and capital losses will be excluded from the computation of Trust Income; and the Trustees will have the sole discretion to utilize or not utilize such deductions, provisions, and alternative calculations available under the Tax Act, including, without limitation, discretion as to timing and amount, in respect of offering expenses, operating expenses, and discretionary deductions.

Trust Income meanss the interest and other income of the Trust determined in accordance with Article 6 of this Agreement.

Trust Income for any Distribution Period means (i) any Facility Fee paid by NRG under the Facility Agreement, with respect to the unexercised portion of the Issuance Right, if any, (ii) any amounts paid by NRG under the Trust Expense Reimbursement Agreement, (iii) any Special Facility Fee paid by NRG under the Facility Agreement, (iv) any cash payments received by the Trust on the Eligible Treasury Assets (other than Retained Eligible Treasury Assets) held by the Trust, (v) any purchase price paid by NRG for any Defaulted Eligible Treasury Assets for an amount equal to the face amount of such Defaulted Eligible Treasury Assets and (vi) any interest paid by NRG on any Senior Notes held by the Trust.

Trust Income means the income of the Trust for any taxation year of the Trust will be the income for such year computed in accordance with IFRS; provided, however, that capital gains and capital losses (as those terms are understood for purposes of the Tax Act) will be excluded from the computation of Trust Income.
