Type A1 Violation definition

Type A1 Violation means a violation by a facility of the regulations, standards, and requirements set forth in G.S. 131D-21 or applicable State or federal laws and regulations governing the licensure or certification of a facility which results in death or serious physical harm, abuse, neglect, or exploitation. The person making the findings shall do the following:
Type A1 Violation means the term as defined in G.S. 131D-34. (8) “Type A2 violation" means the term as defined in G.S. 131D-34. (9) “Type B violation” means the term as defined in G.S. 131D-34.
Type A1 Violation means a violation by a facility of applicable laws and regulations governing a facility which results in death or serious physical harm, abuse, neglect, or exploitation. "Type A2 Violation" means a violation by a facility of applicable laws and regulations governing the licensure of a facility which results in substantial risk that death or serious physical harm, abuse, neglect, or exploitation will occur. A monetary penalty may be imposed on the facility when a "Type A1" or "Type A2" violation has occurred. For family care homes (licensed for two to six beds), the penalty amount may range from $500.00 to $10,000 per violation. For adult care homes (licensed for seven beds or more), the penalty amount may range from $2000.00 to $20,000 per violation. When a facility has failed to correct a "Type A1" or "Type A2" Violation, the range of the fine is up to $1,000 for each day that the violation continued to occur beyond the date specified for correction.

  • OVI or OVUAC violation means a violation of section 4511.19 of the Revised Code or a violation of an existing or former law of this state, any other state, or the United States that is substantially equivalent to section 4511.19 of the Revised Code.

  • Minor violation means a violation that is not the result of the purposeful, reckless or criminally negligent conduct of the alleged violator; and/or the activity or condition constituting the violation has not been the subject of an enforcement action by any authorized local, county or state enforcement agency against the violator within the immediately preceding 12 months for the same or substantially similar violation.

  • Remedy a Violation means to bring the structure or other development into compliance with state and community floodplain management regulations, or, if this is not possible, to reduce the impacts of its noncompliance. Ways that impacts may be reduced include protecting the structure or other affected development from flood damages, implementing the enforcement provisions of the ordinance or otherwise deterring future similar violations, or reducing federal financial exposure with regard to the structure or other development.
